The role of the Lord Chancellor within the cabinet has been renamed the 'Minister for Constitutional Affairs'. However the Lord Chancellor is still a member of the House of Lords. The current Lord Chancellor is Lord Falconer and he has promised not to make any judgements. I think Lord Irvine, the previous Lord Chancellor, made one or no judgements in the House of Lords and it appears that it may become a convention that the Lord Chancellor does not sit as a judge.
Despite the government's attempts at reform, it looks like the posts of Minister for Constitutional Affairs and Lord Chancellor will still be held by one person.
