Could someone please help me on this scenario. Basically it's to do with a rape scenario.
'Charlotte says she overheard Tina (the victim) talking to her friend, Zoe, that she had made it all up and that Zoe should not tell anyone. Zoe has returned back to her home in Canada.
Is this Hearsay? I'm not sure what provision it falls under as Zoe is not the maker of the statement so would s.116 be applicable?
