    Hey guys, really struggling with this question:

    The law governing whether the benefit and burden of freehold covenants runs with the land is full of arbitrary rules and illogical distinctions and needs reform.

    Is it talking about the touching and running with the land requirement or am I completely off the mark, would really appreciate some help or just a nod in the right direction!

    It's simply focusing on the running of freehold covenants.

    Talk about them in registered land, then in unregistered land. Include the formalities, LP(MP)A, LRA, Land Charges Act etc. Talk about how interests in unregistered land are protected (cautions etc).

    Give an example for each which is an authority case, distinguish from another. Discuss. Next point. Don't just state the law, apply it to the question.
