Could someone please explain the curtain principle in land law in a simple way for me please!
if someone wishes to buy the land then they only need to know about what is written and stated in the title register.
if the land is purchased correctly then the equitable interests are overreached and the equitable rights cannot effect the new buyer.
this overreaching does not necessarily destroy the equitable interests though.
