duty of care
Someone goes on holiday in the EU, Hungary.
She had a bad nut allergy, even 1 touch could do serious damage.
Went to the restaurant, informed them, they said they will make sure no nuts.
She had a bite, allergic reaction started, lungs started to close.
Rushed to hospital, saved, brain damage, now living unable to move, talk, however brain fully active.
The restaurant should have followed allergen
regulations in the EU. They had a duty of care of the customers.
They were negligent, they were aware of the allergen problem, and said there was none.
Some sort of miscommunication however and she had the nuts and nearly died.
The restaurant is liable
