Edit: Why the negs? To be 100% sure you need 365 people. I suppose 366 if you include Feb 29th. That's it. End of.

Don't think anyone ever answered you, but if Feb 29th is included you definitely need 367 people to be 100% sure, there are 366 different possible birthdays, so with 366 people in the room it's possible (though extremely unlikely) that everyone in the room has a different birthday, only at 367 can you guarantee a pair exists.
