Would it be legal to copy a start-up app idea?

I was looking at local entrepreneurs and one caught my eye. They've launched an app recently and it's a very interesting concept with massive potential. The idea itself is not unique - there a couple of websites with a similar concept but it does not look like its been done as a mobile app yet. If hypothetically I copied the bulk of the app made some minor changes and launched it myself would that be legal/ be likely to be sued etc or could I argue I was a competitor?

If they took a patent on their app, then you need to get permission from them. If your app takes off, but they have the patent and find out the similarities, they have the right to sue you or take a percentage of your earnings.

Otherwise, no patent means that anybody can copy their ideas and they can't do anything.
