it is illegal to have sex (or perform sexual acts with) someone under the age of 16 so in theory, you should get prosecuted.

It's "technically" illegal but honestly, no-one is going to prosecute you for it- your ages are far too similar. If you desperately want to have sex just be safe about it. When I was 16 (almost 5 years ago) it was very common for 15 and 16 year olds to sleep together and no-one went to jail. I doubt things have changed all that much.
