Problem with a landlord trying to make changes to contaract

Hi there.

Me and my two friends where living on 6 months contract that is about to end soon. We asked the landlord to extend it on periodic basis or for 3 months as we are unsure of where we are going to live next.

we received this replay from him and agency:

With regards to your communication regarding the terms of renewal of the tenancy agreement, the following are the only options we can offer for you:

Option 1:
To renew for a six (6) months contract this is from 24 March 2017 to 23 September 2017 with the following additional terms & conditions:
A. during the said tenancy period, the Agent of the Landlord will be allowed to market and advertise the apartment for letting.
B. The Agent will also be allowed access to the apartment during this period for viewing of potential tenants.
C. On the expiry of the contract, the tenants shall immediately vacate and handover the apartment back to the landlord or the landlord’s agent as per the terms and conditions of the tenancy contract.
D. No extension will be allowed to the tenant after the expiry of the contract.

Option 2:
To renew for twelve (12) months and the Landlord will sign the Tenancy Contract with its original terms and conditions.

Please note that the landlord is not giving the option to renew for three (3) months nor on a monthly rent basis.

Should the above options are not amenable to you, consider this as our reminder for you to vacate and handover the apartment back to us on the expiry of the contract.
The terms of the tenancy contract with regards to the handover procedure should be observed and complied with by the tenants.

We anticipate receiving your decision until Friday, 10th March 2017.

My question is if he can really do that?
We don't like this terms, that they could come in any time to our rooms and show them to other people. Neither we will have enough time to find new place as they say that in 2/3 weeks when the contact ends we would have to leave the place.

Please let us know if we could do sth about this, for example gain 2 additional months to find new place and stop dealing with this landlord.

Yes of course he can. After the initial rental period some landlords will allow you to carry on month to month
It is not worth the hassle for three month contracts
You'll either have to sign for 6 or 12
He hasn't changed the terms of the contract. He has offered 2 options to renew. If you don't want to you'll have to leave!!!!
Yes the landlord is absolutely allowed to do this. In terms of showing people round the property and into your bedrooms, he would not be able to do this at unreasonable times e.g the night, and he should give you warning when he is planning to come over.

Nothing wrong with the LLs terms maybe ask for 24 hours notice, but beyond that your contract is ending an he doesn't have to renew. You have left it to the last minute. he wants to get someone in place for the next year.

He doesnt have to offer you 3 months or a periodic tenancy and i can see why, it suits you, but it doesnt suit him.

You're always allowed 24 hours notice of the landlord coming round, and the clauses in the contract can't override that. But yes, they are allowed to specify that you can either rent for a further 6 or 12 months - if you don't agree you can try to negotiate, but it's their house.
Get back in touch stating you'll extend for 6 months on the understanding that you retain your right to 24 hours notice before the landlord enters the property. It's pretty normal for them to want something like this, 3 months isn't very helpful to him, he wants the property filled for longer and it's very standard to have people coming and viewing the property towards the end of your tenancy.
If you have an assured shorthold tenanacy, then even when you come to the end of the fixed period you have a right to remain until the landlord serves a s21 notice, under which he has to give a minimum of two months' notice. Even then, if you don't leave he would have to get a court order to gain possession - it's not just a case of getting chucked out.

Yes, of course - but the landlord still has to comply with the law on ASTs, so I don't think the OP should feel blackmailed that he can't exercise his rights under that tenancy for fear of getting a bad reference. I'm not suggesting the tenants refuse to leave and the LL has to go to the lengths of getting a court order to gain possession, but they do automatically have entitlement to 2 out of the 3 months they're seeking, which might be enough to tide them over.

I'm surprised the LL didn't serve a s21 four months into this six-month tenancy - which would have then expired a couple of days after the end of the fixed period, but seeing as he hasn't it's to the tenant's advantage.

Just shows the usual studient misinformation, The LL can REQUEST viewings but it should be thrown out of court if it went that far.

You can legally change the locks if you want as long as you put originals back on when you leave, and refuse all viewings no matter if its in contract or not
