Defences for not implementing a directive??

If member states have failed to implement a directive with the reasons being:

'taken time to form a government, which has caused a significant backlog in the passing of all legislation'

and

'protracted negotiations with construction and property development companies, who have reacted angrily to the proposals, threatening to cease all construction projects if the directive was implemented' -- what possible defences and rights could they have against the EC??
