Leaving a tenancy agreement??

Hi everyone , I have a question I’m hoping someone can give me answers. I moved into a house from a letting agency and the contract is said to be ending in August. I haven’t been at the house for a month already as I had to come back home due to family issues. The next payment is due on the 17th of April and I spoke to the landlord 3 weeks ago that I can no longer live there he said I’d have to find a replacement. I’m really struggling to find one :// the contract however does not say that the tenancy ends in august which I found weird , it only has the start date and not even how much rent I have to pay. The only thing I’m worried about is whether this is a joint tenancy as all of our names are on the contract , does this mean it’s a joint tenancy?

It took me a moment to understand how it could be the case both that "the contract is said to be ending in August" and "the contract however does not say that the tenancy ends in august". Then I realised that you'd likely been verbally told that's when the contract ends, even though that's not actually written into the contract. Is that right?

If the contract does not have an end date, does it have a duration? Does it have any details as to the early termination of the contract? (For example, saying that either party can terminate the contract having given three months' notice in writing.)

If the contract has multiple names on it, then it's almost certainly a joint tenancy. If that's the case, then your not really looking for the tenancy to end (as that would impact everyone else).

The only options you have really are:
1. Continue paying your share of the rent, even though you won't be there.
2. Finding a replacement tenant, as suggested by your landlord - although you say you're finding that difficult.
3. Persuading the other tenants to cover your share of the rent. (For example, if there are 5 of you sharing right now, and you leave, the total rent for the property would not be split into 4 parts, not 5.) You'd probably want your landlord to produce an updated contract, without your name, in this case.

Have you spoken to your Students' Union to see if they can help? They'll likely have specialists who understand tenancy contracts, and should be able to help. Good luck!

Yes I was verbally told however it doesn’t have an end date or duration. Only the start date. And no details of termination.

+1 on running this by Shelter.

Very odd that there is no end date.

I also question whether they have messed up other paperwork too (e.g. not following all the rules around protecting your deposit, or not having a HMO licence) that might mean you are entitled to a rent refund / money from the landlord. Shelter can advise on this as well.

Hi there,
I agree with the other posters that you should run this by your Student Union if they have an accommodation support team. It does seem odd that there is no end date or breakdown of how much you are expected to pay. Does the letting agency have a cancellation policy on their website? I would recommend if so that you read into that. You can often find tenancy takeovers on forums like TSR.
