Got a 5 in foundation but a 9 in higher tier German GCSE the year after.

Can I put the most recent exam result the higher tier German while leaving the foundation one out
The school made me do foundation german gcse but now I have done the GCSE higher tier and got a 9. On my UCAS can i just put the 9 on higher tier whilst leaving out the foundation exam. Would UCAS know about it if i left it out.
