Is my dismissal unfair?

I was recently dismissed from my job with immediate effect (had to leave the place asap), whilst still on my 3 month probation period. However, in my contract it stated ‘Your employment may be terminated by the Firm during this period at any time on one week’s prior written notice’. Obviously I wasn’t given a weeks notice as I was expected to leave the office asap, so do I have reasonable grounds to bring forward a claim for unfair dismissal?

Generally the probation period does not count, it’s a probation period for a reason they don’t need to give you notice.

Depends why you were let go. They usually have caveats for instant dismissals such as negligence etc.

When someone says « leave now » rather than at the end of the day, week or month there is generally a reason. You, I imagine know what that reason is. As you were only on a probation period the company owe you at best a weeks wages and maybe less. If you appeal, the reason for why you were let go will become common knowledge. Is this something that would bother you?

If they wanted to get rid of you for any other reason during your probation then they would have to give you the weeks notice as said in your contract. But seeing as you got dismissed, id imagine that would give them the green light to get rid of you immediately. Especially if the reason they dismissed you was something serious.
You could appeal, but i dont know how far you would get.

Appealing a probationary period dismissal is a fool's errand.

Also, to bring a claim for unfair dismissal, you have to have worked for the company for a minimum of two years.

Generally if you are told to leave/escorted out on the spot there will be a reason that would make the concept of notice moot. As said above, complaining is likely without merit during probation.

Your rights are pretty limited at this stage. You might be able to argue for your weeks notice pay, and particularly if they didn’t follow procedures. Get some legal advice and join a trade union

Immediate leaving the building is usually gross misconduct. There would be no notice period.

We cannot comment unless we know the reasons why they said you were dismissed.

No, I don’t believe you do. Just reach out to a union related to the sector you did or want to work in. I retained my trade union membership while between jobs and benefited from a very reasonable rate while unemployed
