Maintenance Loan - pregnant migrant worker

Hello,

My wife is a student a has a migrant worker status. We are planning to have a baby and are wondering whether she would still receive maintenance loan?

She is an agency worker and works 16hrs per week throughout the year so she is eligible at the moment. However, she will definitely not work in the last weeks of her pregnancy and for a few months after giving birth as she will be receiving maternity pay.

Technically she won’t work but will have income in the form of maternity pay - will that be accepted? Will she still be eligible?

As long as they have been in employment and working prior to going on maternity leave and will be returning to the same employer once the maternity leave has ended they can be eligible for the Maintenance Loan still.

We will require the student’s standard employment evidence (contract, payslips etc) along with a letter from their employer confirming the date the student started and will return from maternity or a letter from the DWP confirming their maternity allowance entitlement. Once the student returns to employment after maternity, they will need to send us their first payslip showing their actual hours worked so we can confirm they are still working at a sufficient level.
